Acceptance of Terms

By accessing the website at https://jackstache.com, or by signing up for any services provided by Jackstache Marketing ("we," "us," or "our"), you agree to be bound by these Terms and Conditions. If you do not agree with any of these terms, you are prohibited from using or accessing this site or our services.

SMS Messaging Terms (A2P 10DLC)

By providing your phone number to Jackstache Marketing, you agree to receive recurring automated marketing and informational text (SMS) messages from us.

Consent: Consent to receive marketing text messages is not a condition of any purchase.

Frequency: Message frequency varies. You may receive alerts, appointment reminders, and project updates.

Rates: Message and data rates may apply depending on your mobile carrier plan.

Opt-Out: You can unsubscribe from these messages at any time by replying STOP. We will send a final confirmation message to confirm your unsubscribe status.

Carrier Liability: Carriers are not liable for delayed or undelivered messages.

Services & Scope of Work

Jackstache Marketing provides digital marketing, website design, and hosting services.

"Free Website" Offer: If you engage us under our "Free Website Setup" promotion, you acknowledge that the setup fee is waived in exchange for a monthly software/hosting subscription.

Ownership: The website design, layout, and underlying code provided by Jackstache Marketing remain the intellectual property of Jackstache Marketing. You (the Client) are granted a license to use this design as long as your monthly subscription is active. You retain full ownership of your own content (images, logos, and text).

Cancellation: If you cancel your monthly subscription, your license to use the website design is revoked, and the site will be taken offline at the end of the current billing cycle.

4. Payment & Refunds

Subscription Fees: Monthly hosting and software fees are billed in advance.

Refund Policy: Monthly subscription fees are non-refundable. Cancellations must be made at least 3 days prior to your next billing date to avoid being charged for the following month.

Limitation of Liability

In no event shall Jackstache Marketing or its suppliers be liable for any damages (including, without limitation, damages for loss of data or profit, or due to business interruption) arising out of the use or inability to use the materials on Jackstache Marketing's website, even if Jackstache Marketing or a Jackstache Marketing authorized representative has been notified orally or in writing of the possibility of such damage.

Governing Law

These terms and conditions are governed by and construed in accordance with the laws of British Columbia, Canada, and you irrevocably submit to the exclusive jurisdiction of the courts in that location.

Changes to Terms and Conditions

Jackstache Marketing reserves the right to change these Terms and Conditions at any time. Changes will be communicated through our website or direct communications where feasible.
